Commission Regulation (EC) 906/2009 for liner shipping consortia: conditions, 30% share cap, hardcore list, extensions and expiry in 2024.
The Consortia Block Exemption Regulation, Commission Regulation (EC) No 906/2009, exempted liner shipping consortia from Article 101 TFEU from 26 April 2010, subject to a 30% market share cap and a list of hardcore restrictions that included price fixing to third parties. Extended to 2020 and then to 25 April 2024, it expired on that date after the Commission decided on 10 October 2023 not to renew it.
The full article will cover its conditions, the evaluation, and the position of vessel sharing agreements after expiry. See bunker adjustment factor .
