EU ETS Neighbouring Container Transhipment Ports
The anti-evasion rule excluding calls at listed non-EU transhipment ports from the port-of-call definition under the EU ETS and FuelEU.
Under Article 3ga(2) of Directive 2003/87/EC and Article 2(2) of the FuelEU Maritime Regulation, the Commission lists neighbouring container transhipment ports: ports outside the Union, less than 300 nautical miles from an EU port, where transhipment exceeds 65% of container traffic. A stop at a listed port is not a port of call, so it does not shorten the leg counted at 50%.
