EU Sulphur Directive (EU) 2016/802
Directive (EU) 2016/802 on the sulphur content of marine fuels: the 0.10% at-berth limit, non-availability, supplier registers and EU sampling rates.
Directive (EU) 2016/802 of 11 May 2016 is the codified EU law on the sulphur content of liquid fuels, including marine fuels used in EU waters. It carries the MARPOL Annex VI limits into EU law and adds rules of its own, most notably a 0.10% by mass limit for ships at berth in Union ports under Article 7.
Article 6(3) applied the 0.10% limit in EU waters of the Mediterranean SECA from 1 May 2025 without amendment.
The full article will cover the at-berth rule and its exceptions for stays under two hours and ships on shore power, the non-availability procedure in Article 6(8), the supplier register and BDN rules in Article 6(9), and the penalty article. It will cover Commission Implementing Decision (EU) 2015/253 on inspection and sampling rates and annual reporting of non-availability claims.
