GENCON 1994
The GENCON edition still in circulation: its laytime, cancelling and strike provisions, and what GENCON 2022 replaced.
GENCON 1994 is the BIMCO uniform general charter that served the dry cargo voyage market for nearly three decades and remains in circulation alongside GENCON 2022.
The 1994 edition is a short form by modern standards, leaving much to rider clauses. Its cancelling provision deems the new cancelling date to be the seventh day after the owner’s new readiness date, with no election for the charterer, which is the mechanism GENCON 2022 replaced with a single new ETA and a charterer’s election to accept or cancel. GENCON 1994 also has no equivalent of the GENCON 2022 clause 16 right to suspend performance and to terminate after a 96-hour notice.
