MARPOL Annex III Reg 9: Port State Control

MARPOL Annex III Regulation 9 lets a port State inspect operational requirements for packaged harmful substances; numbered 8 until MEPC.246(66) took effect.

MARPOL Annex III Regulation 9, “Port State control on operational requirements”, is the control provision for harmful substances carried in packaged form. In the revised Annex III adopted by Resolution MEPC.193(61) it was Regulation 8; Resolution MEPC.246(66), in force 1 January 2016, inserted a new Regulation 1 on definitions and renumbered the rest, so the control provision has been Regulation 9 since that date. IMO Resolution A.1206(34) paragraph 1.4 lists it as “regulation 9 of Annex III”.

The full article will cover the regulation text, its use alongside the IMDG Code, the clear-grounds and detention guidance, and the parallel provisions in the other annexes, including Annex IV Regulation 14 .
