Reachable on arrival and always accessible
Two berth nomination warranties that are not equivalent, and the departure undertaking that separates them.
Reachable on arrival and always accessible are berth nomination warranties given by the charterer, and they are not interchangeable. Under the Laytime Definitions for Charter Parties 2013 the first addresses the ship getting in; the second adds an undertaking that she can also leave safely and without delay.
That departure undertaking is the whole negotiation in an ice-affected or tidally constrained port, because it moves the risk of the ship being trapped after completion from the owner to the charterer. A charterer offering always accessible is accepting an exposure that reachable on arrival leaves with the owner.
The full article will set out both definitions, the case law on each, the interaction with ice clauses and with tidal and draft restrictions, and the demurrage and detention consequences where either warranty is broken.
