Sue and labour is the assured’s duty to take reasonable measures to avert or minimise a loss, and the insurer’s matching obligation to pay the costs. Institute Cargo Clauses 1/1/09 clause 16 reimburses charges properly and reasonably incurred in addition to any loss recoverable, and the Marine Insurance Act 1906 s.78 is the statutory basis.
