Suez Canal Authority
The Egyptian state body that operates the Suez Canal: its founding law, its charging power, and its non-discrimination duty.
The Suez Canal Authority is the Egyptian public body that manages, maintains and improves the Suez Canal. It operates under Republican Decree Law No. 30 of 1975, signed on 29 May 1975, which repealed Law No. 146 of 1957 and gave the Authority independent juristic personality governed by that law alone.
Article 8 of the 1975 law is the domestic power behind every tariff circular: it permits the Authority to impose and levy tolls on navigation and transit and on pilotage, towage, berthing and similar services. Articles 14 and 15 bind it the other way, forbidding any measure against the free-navigation provisions of the Convention of Constantinople of 1888 and any privilege granted to one vessel or person that is not granted to others in the same circumstances.
The full article will cover the Authority structure and finances, the tariff circular cycle, its pilotage and traffic control functions, its salvage and towage arm, and the relationship between its rulebook and the treaty obligations Egypt has re-enacted in its own statute.
